Default Airborne Class Action Lawsuit Settlement

I got this from Joe Consumer: If you purchased any Airborne vitamin supplements, you're eligible to submit a claim under the Airborne class action lawsuit. If you misplaced your receipts, you can still submit a claim for up to 6 boxes of Airborne at average retail pricing. ($6.99 per box)

Airborne is basically a vitamin supplement. The problem is, in marketing the product, the company made false claims that it can cure or prevent the common cold. That's the basis of this class-action lawsuit.

The settlement hasn't been approved yet. There will be a court hearing on June 16, 2008, and even if the settlement is approved, the company may take up to a year to appeal the decision. However, the deadline for filing a claim is September 15, 2008.

Even as a consumer that bought Airborne should I try to redeem this? I actually thought Airborne was useful although it might have misclaimed some information.

I still use Airborne.

It's your choice. I posted the info but I really can't decide for anyone whether to join or not to join the class action lawsuit.
  1. It's only a refund of $7 per pack, unlikely to mean much to the bottom line these days.
  2. A $23 million settlement is not going to break a company that takes in over $100 million in revenues per year.
  3. It sends a message to the health supplement industry to be careful in the claims that they make.

I'm actually pretty happy about this class action suit. I think that there are many potential benefits to natural problems, but I think that they should be held to some of the same levels of testing and review that "medical" drugs are if they are going to make claims like that.

On the flip side, I'm a little tired of all these remedies for the common cold being invalided. If nothing else, I want a placebo I can believe in!
